1. Introduction

These Terms of Service (“Terms”) apply to your use of the ProFaceFinder website, applications, and services (“Services”).
By using the Services, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use ProFaceFinder.

2. Eligibility

You must be at least 18 years old to use the Services.
You are responsible for ensuring that your use of ProFaceFinder complies with the laws of your country or region.

3. Description of Services

ProFaceFinder provides an automated visual similarity search tool.
The Service analyzes the visual characteristics of images you upload and returns links to publicly accessible pages where visually similar content may appear.

We do not:

access private or password-protected platforms
collect data from social media
monitor accounts, private messages, or closed systems
host or control any third-party content

Search results consist of public links and small preview thumbnails for convenience only.

4. User Responsibilities

By using the Service, you agree to:

Upload only images you own or are authorized to use
Use the Service only for lawful and personal purposes
Not attempt to investigate, track, or analyze other individuals
Not engage in harassment, stalking, discrimination, or any harmful activity
Maintain accurate account information
Protect your login credentials and use a secure device

Any misuse may result in suspension or permanent account termination.

5. System Requirements & Security

You are responsible for using:

An up-to-date device with a modern web browser
A secure internet connection
Antivirus protection and a strong password (min. 8 characters with mixed symbols)

We are not responsible for unauthorized access caused by weak passwords, malware, or device-level vulnerabilities.

6. Data Processing & Consent

By uploading a photo, you give explicit consent for ProFaceFinder to:

Process the image temporarily to generate a non-reversible numerical representation
Perform your requested search
Delete the original image immediately after processing
Retain temporary data for up to 24 hours to deliver results, unless you choose optional monitoring features

We do not store personal identifiers with this data and do not create permanent profiles.

7. Account Plans

ProFaceFinder offers two subscription plans:

Pro Plan – includes 2 searches and mobile access
Premium Plan – includes 7 searches, faster processing, and priority support

Plan features, limits, and pricing may change over time.
Updated details are always available on our website.

8. Payments, Billing & Auto-Renewal

All payments are made in advance
Subscriptions renew automatically unless canceled before the next billing cycle
You may cancel anytime through your account settings
Access remains active until the end of your paid period
Prices may include or exclude VAT/local taxes depending on region
Payments are processed securely by third-party PCI-DSS-compliant providers
We do not store full card details

9. Trials & Promotions

Trial access or promotional offers may be changed, limited, or withdrawn at any time.
Abuse of discounts or promotions may result in account restrictions.

10. Refund Policy

Refund requests must be made within 30 days and are only considered if:

No searches have been performed
No alerts or monitoring features were used
No takedown requests were submitted
The account has not been deleted
No policy violations occurred

Refunds for duplicate charges or verified technical errors may be granted at our discretion.

Responses are normally provided within 5–7 business days.

11. EU/UK Right of Withdrawal

By starting a search, you request immediate service delivery and waive your 14-day withdrawal right for that billing period.
If you have not performed a search, you may withdraw within 14 days by contacting support.

12. Fair Use & Abuse Prevention

We monitor general usage patterns to maintain system stability.
Accounts may be throttled or suspended if showing signs of:

automated usage
excessive or abnormal search volume
attempts to bypass limits or interfere with service integrity

We do not view your uploaded images or personal results.

13. Opt-Out & Takedown Requests

If visual matches of your content appear in results and you want them removed:

Submit an opt-out request with confirmation that the content belongs to you
We verify and block associated URLs and image hashes from future results
Processing is normally completed within 24 business hours

Because online content changes, new versions of the same image may appear; additional requests may be needed.

14. Communication

Official communication takes place via support@profacefinder.com.
All inquiries must be in English.
We send important updates to the email linked to your account; keep it current.

15. Service Availability

We aim for uninterrupted availability but do not guarantee continuous uptime.
Maintenance, updates, or outages may occur.
We are not liable for temporary unavailability or performance reductions.

16. Intellectual Property

All text, software, trademarks, graphics, and other assets on ProFaceFinder are our property or licensed to us.
You may not copy, modify, distribute, or resell any part of the Service without our written consent.

17. Disclaimer of Warranties

The Service is provided “as is” and “as available.”
We do not guarantee:

accuracy or completeness of results
that all visual matches will be found
uninterrupted operation

Use ProFaceFinder at your own risk.

18. Limitation of Liability

To the maximum extent permitted by law:

We are not responsible for indirect, incidental, or consequential damages
We are not liable for third-party site content linked in search results
Total liability for any claim will not exceed the fees paid in the three months prior to the event

19. Indemnification

You agree to defend and indemnify ProFaceFinder, its team, and contractors against claims arising from:

your use of the Services
your breach of these Terms
your violation of third-party rights

20. Termination

We may suspend or terminate your access if:

you violate these Terms or laws
we detect fraud, abuse, or risk
we receive a lawful request to do so

You may cancel your account at any time. Termination ends all rights to use the Services immediately.

21. Governing Law & Jurisdiction

These Terms are governed by applicable laws shown on this page.
Disputes will be resolved in the competent courts of your jurisdiction unless consumer law grants different rights.

22. Compliance, Export & Sanctions

You confirm you are not located in a restricted or sanctioned jurisdiction and are legally permitted to use the Services.

23. Final Provisions

These Terms and the Privacy Policy form the entire agreement between you and ProFaceFinder.
If any clause is invalid, the remainder stays in effect.
Failure to enforce a right is not a waiver of that right.
